These terms apply to website design, build, hosting and maintenance services provided by TOBR Digital ("we", "us"), a sole trader based in the United Kingdom, operated by Tom Bradshaw. By engaging our services, you ("the client") agree to the terms below.
We provide website design and build services, ongoing hosting and maintenance, and optional photography services, as described in our current pricing tiers. Exact deliverables for your project will be confirmed in writing (email is sufficient) before work begins.
We provide an initial mock-up of your website before any binding agreement or payment is required. Once you approve a design and pricing tier, this constitutes acceptance of these terms for that project.
Every website build includes up to two rounds of revisions on the initial design and mock-up. If, after two rounds, you're still not happy with the direction, your deposit will be refunded in full and no further obligation applies on either side. Revisions beyond the second round, or requested after the site has gone live, may be charged separately depending on scope.
Upon full payment for a website build, you own the final website design, content and domain name outright. We retain hosting and technical management of the site for the duration of your monthly plan. If you cancel your plan, we will provide your website files and domain transfer details within 21 days of your notice period ending.
Where a photo shoot is included in your package, you are granted a license to use the resulting photographs on your own website and marketing materials. We retain the right to use the same photographs in our own portfolio and marketing, unless you request otherwise in writing.
You are responsible for the accuracy of information provided about your business (pricing, services, claims, certifications, and similar) that appears on your website. We are not responsible for verifying the truth of client-supplied content.
Monthly hosting and maintenance plans can be cancelled at any time with 21 days' written notice. There is no minimum contract term. This 21-day window allows time for a proper handover of your domain and website files. Cancellation does not entitle you to a refund of the current month's payment already made.
We aim to keep your website online and secure at all times, but we cannot guarantee uninterrupted availability, and are not liable for losses arising from downtime, third-party service outages (such as our hosting provider), or issues arising from content you have supplied. [This section in particular should be reviewed by a solicitor to make sure it's enforceable and appropriately limits your liability.]
These terms are governed by the laws of England and Wales.
